DMCA Policy

1. Our Commitment

Poketmart complies with the Digital Millennium Copyright Act (DMCA). We take copyright infringement seriously and will promptly respond to valid takedown notices. We also maintain a repeat infringer policy that results in account termination for users with multiple copyright violations.

2. Filing a DMCA Takedown Notice

If you believe your copyrighted work has been infringed on Poketmart, please send a written notice to our designated agent containing:

1. Your full legal name and contact information (address, phone, email)
2. Identification of the copyrighted work you claim has been infringed
3. Identification of the infringing content on Poketmart (URL or description)
4. A statement that you have a good faith belief that the use is not authorized by the copyright owner
5. A statement that the information in your notice is accurate, under penalty of perjury
6. A statement that you are the copyright owner or authorized to act on their behalf
7. Your physical or electronic signature

4. Counter-Notice Process

If your content was removed in error, you may submit a counter-notice containing:

1. Your full legal name and contact information
2. Identification of the removed content and its location before removal
3. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake
4. Your consent to jurisdiction in your federal court district
5. Your physical or electronic signature

Upon receiving a valid counter-notice, we will notify the original complainant. If they do not file a court action within 10–14 business days, we may restore the content.

5. Repeat Infringer Policy

Poketmart will terminate the accounts of users who are determined to be repeat infringers. A user who receives three or more valid DMCA takedown notices will have their account permanently suspended.

6. False Claims

Be aware that under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney fees. Poketmart reserves the right to pursue legal action against those who submit false DMCA notices.

7. What Happens After a Notice

Upon receiving a valid DMCA takedown notice, Poketmart will:

1. Promptly remove or disable access to the allegedly infringing content
2. Notify the seller (or uploader) that their content has been removed
3. Document the notice for our records
4. Investigate repeat violations per our repeat infringer policy
